1. Introduction DivaDance ("DivaDance," "we," "us," or "our") is a franchise dance company with multiple independently owned and operated locations. This Privacy Policy explains how we collect, use, disclose, and protect personal information when you use our websites and online services that link to this Policy (collectively, the "Services"). If you do not agree with this Policy, do not use the Services. We may update this Policy periodically. The Effective Date above reflects the latest version.
2.0 Information you provide We collect the information you submit directly to us, such as when you request info, book a class or party, or join a marketing list. This includes contact details such as your name, email address, phone number, and city/market (nearest location). It also includes the contents of messages or forms you submit, survey responses, and your preferences. To plan an event, we collect necessary event and party details; for teen parties we request parent/guardian contact details and may collect an optional first name for the guest of honor. If you submit a form to book or request services, a Mindbody account is created for you to manage scheduling. Based on that submission, you agree to receive marketing emails and (where applicable and permitted by law) texts from DivaDance or the relevant franchise location. You can opt out at any time. Consent to marketing is not a condition of purchase.
2.1 Information collected automatically We and our service providers automatically collect certain information about your device and how you use the Services. This includes technical identifiers like your IP address, device IDs, browser/OS type, language, and approximate location derived from your IP. We also collect usage data, including pages viewed, links clicked, referring/exit pages, time/date stamps, and similar interactions. This is done using cookies, pixels, tags, and local storage for functionality, analytics, and advertising.
2.2 Information from franchisees and third parties If you select a specific city/location, we will share your lead details with the independent DivaDance franchise that serves that area so they can contact you and fulfill your request. Franchisees receive only the data relevant to their pipeline. We also receive information from tools we use to operate the business, including Mindbody, Keap, Mindbody marketing tools, and Messenger AI, as well as analytics and ad platforms. If you interact with us on social media or respond to ads, we may receive limited info from those platforms consistent with your settings. We treat third-party data with the same care as data you provide directly.
3. How We Use Information We use personal information to provide and operate the Services, including scheduling and managing classes/events, processing requests, customer support, and personalizing content by location. We use it to communicate confirmations, reminders, updates, responses to inquiries, and notices about policy changes. For marketing and promotions, we send emails and, where permitted, texts about classes, offers, openings, and events, which you can opt out of at any time. We also use information for advertising and measurement to deliver and measure advertising on platforms such as Meta, TikTok, Pinterest, Reddit, and Google Ads, build audiences, and assess campaign performance. For analytics and improvement, we seek to understand site usage, debug, enhance features, and develop new offerings. Information is also used for safety and legal purposes, such as to protect our Services, detect/prevent fraud and abuse, comply with laws, and enforce terms. For franchise operations, we allocate leads, support local service delivery, and compile aggregated insights for performance and planning. We may also use information for other purposes with your consent or as disclosed when the information is collected.
4. Cookies and Online Advertising We and our partners use cookies, pixels, and similar tech for site functionality, analytics, and ad personalization/measurement. We use analytics services like Google Analytics to understand usage patterns. You can manage analytics via browser controls and Google's opt-out add-on. We work with advertising partners such as Meta, TikTok, Pinterest, Reddit, and Google Ads to show ads and measure results, including for retargeting and creating lookalike audiences. These partners may set or read cookies or use device IDs. Our use of ad cookies may be considered a "sale" or "sharing" of identifiers and internet activity under some state privacy laws. You can manage cookies via your browser and any cookie banner or consent tool available on the site. Industry opt-outs are available via the DAA and NAI, and mobile users can limit ad tracking in their OS settings. Opt-outs are browser/device-specific and may reset if you clear cookies. We currently do not respond to browser Do Not Track signals.
5. How We Share Information We share personal information as needed to operate the business. This includes sharing information within the DivaDance system with the local franchisee serving your selected market so they can contact you and deliver services; franchisees receive only leads relevant to their location. We share information with service providers who perform services for us, such as hosting, scheduling (Mindbody), CRM (Keap), marketing/SMS, chat (Messenger AI), analytics, advertising, and email/SMS delivery, as well as professional advisors. These vendors must use data only to provide services to us and protect it appropriately. Information is shared with advertising/analytics partners, which may include hashed contact info for audience matching where permitted. We may share information for legal or safety reasons to comply with the law, respond to lawful requests, or protect rights, property, and safety. In connection with mergers, acquisitions, reorganizations, or asset sales, information may be shared as part of a business transfer. We also share information with your consent or when you ask us to. We do not sell your personal information for money, and we do not share your contact details with unaffiliated third parties for their own direct marketing.
6. Your Choices You may unsubscribe from marketing emails using the link in the email or by contacting us, though you will still receive non-marketing messages like confirmations. To opt out of marketing text messages, you can reply STOP at any time; message and data rates may apply. Consent to texts is not required to buy goods or services. You can use browser settings and the site's consent banner to manage non-essential cookies, and also use industry opt-outs (DAA/NAI) and mobile OS settings.
7. Your Privacy Rights (U.S. State Laws) If you reside in a state with a comprehensive privacy law (e.g., California, Colorado, Connecticut, Utah, Virginia), you may have certain rights, subject to verification and exceptions. These rights may include:

7.1 California Notice at Collection We collect categories of personal information including identifiers (e.g., name, email), internet/network activity, approximate location, and in limited cases inferences for marketing. This information is used for the purposes described in the "How We Use Information" section and shared as described in the "How We Share Information" section, including for targeted advertising. Retention of data varies by category and purpose and is tied to operational needs, legal requirements, and security.
7.2 Do Not Sell or Share My Personal Information You can opt out of cross-context behavioral advertising by submitting a request via hq@divadance.com or through our "Your Privacy Choices" link in the site footer. These opt-outs are browser and device-specific.
7.3 Nevada We do not sell personal information as defined by Nevada law. Nevada residents may still submit opt-out requests to the email above.
8. Children's Privacy Our Services are intended for adults, and we do not knowingly collect personal information from children under 13. Parents or guardians must provide any required contact information for teen parties or minors' participation. If we learn we have collected info from a child under 13, we will delete it.
9. Data Security We use administrative, technical, and physical safeguards designed to protect personal information, such as role-based access, encryption in transit where appropriate, and secure hosting. No system is perfectly secure, and the transmission of data is at your own risk. We will notify you of a breach as required by law.
